These Terms of Service ("Terms") govern your access to and use of the Car Plug 559 website (the "Site") operated by Car Plug 559 ("we," "us," or "our"). Please read these Terms carefully before using the Site.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Our Service

Car Plug 559 is a cash-only used car dealer based in Fresno, California. The Site displays our current vehicle inventory, pricing information, photos, and related business details so you can browse what is available.

The Site is an informational browsing experience. It does not process online payments, financing applications, shipping bookings, or final purchase agreements. To inquire about or purchase a vehicle, you must contact us directly through Instagram Direct Message or Facebook Messenger.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site for purchase-related purposes. If you use the Site on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Inventory, Pricing, and Availability

We try to keep inventory, photos, prices, and vehicle details accurate and up to date. However, information on the Site may be updated, corrected, or removed at any time without notice. Listings may be imported from our Instagram posts and other internal sources, and delays or errors may occur.

• A vehicle shown as available may already be sold, reserved, or pending sale.
• Displayed prices, mileage, features, and descriptions are not guaranteed.
• Promotional pricing or sale timers may expire automatically.
• The only binding terms of any sale are those agreed directly with us off the Site.

You should confirm price, condition, title status, availability, and all sale terms with us before relying on any listing.

4. AS-IS Sales and No Warranty

Unless we expressly agree otherwise in writing during a direct sale conversation, all vehicles are offered and sold AS-IS, with all faults, and without any warranty, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Used vehicles may have wear, mechanical issues, accident history, or other defects not fully visible in photos or descriptions. You are responsible for inspecting any vehicle and verifying its condition before purchase.

5. Off-Site Transactions

Communications, negotiations, payments, delivery arrangements, and final sale agreements happen outside the Site through Instagram, Facebook Messenger, phone, or in person. We are not responsible for outages, message delays, account restrictions, or other issues caused by third-party messaging platforms.

Any purchase is subject to separate terms we provide at the time of sale, including identification requirements, payment method restrictions, and transfer procedures.

6. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to the Site, admin areas, servers, or data
• Scrape, crawl, harvest, or copy Site content through automated means without permission
• Interfere with or disrupt the Site's operation or security

We do not control third-party services and are not responsible for their content, policies, availability, or practices. Your use of third-party services is governed by their own terms and privacy policies.

Our use of Instagram and Facebook platform data is also subject to Meta's Platform Terms and related developer policies.

9. Admin Access

Certain parts of the Site are restricted to authorized administrators. Admin credentials may be issued only to individuals we approve. You may not attempt to access admin areas without authorization. Admin users must keep login credentials confidential and notify us promptly of suspected unauthorized access.

10. Disclaimers

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ANY INFORMATION ON IT, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAR PLUG 559 AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US DIRECTLY FOR USE OF THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless Car Plug 559 and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in Fresno County, California, and you consent to their jurisdiction and venue.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Car Plug 559 regarding use of the Site. They do not replace any separate written agreement for the purchase of a vehicle.
